Shard Learning - Terms of Use and Acceptable Use Policy
Last updated: 29 September 2026
1. Purpose and audience
These terms are the agreement between Shard Learning Pty Ltd and the people who use the Shard Learning platform. A school accepts them for the students it enrols; a teacher and an adult taking part in professional learning accept them for themselves.
These terms and the acceptable use policy in annex P18-A can be read in full before anyone creates an account. How we handle personal information is set out in our Privacy Policy.
2. Who may use the platform, and how access begins
There are four ways an account begins:
- a teacher creates the account and invites the student;
- a student registers against a class code their teacher has issued;
- a participant registers directly on a partner programme page;
- a student joins a live classroom session with a session code, giving no email address and no password.
A teacher account is verified before it can be used.
A school that brings students onto the platform confirms that it has the consent framework and the authority to invite them, and that it holds the relationship with their parents and guardians.
Sign-in details belong to one person and are not shared. We may reset a credential we believe is compromised.
3. Acceptable use
Everyone who uses the platform agrees not to:
- use it for anything unlawful, dishonest, or harassing, threatening or demeaning to another person;
- interfere with the platform or with anyone else's use of it, or introduce malicious code;
- reach an account, a class or a record they have not been given access to, or work around a security control;
- collect lesson content by automated means, or copy or republish it in bulk;
- use another person's account, or let another person use theirs;
- use the platform, or the content in it, to compete with us, without our written consent.
Annex P18-A explains this section to students in plain words, and is published at shardlearning.com/terms-and-privacy.
4. Your work, and our content
A student owns the work they create on the platform. Nothing in these terms transfers that ownership to us.
We hold a licence over that work for three purposes only: to store it, to show it back to the student, and to show it to the teacher who owns the class the student is in. The licence ends when the work is deleted.
Work is removed only where it is unlawful, unsafe or breaches section 3, or where the student or their school asks.
The lessons and the platform are ours or licensed to us. A school, its teachers and its students may use them for teaching and learning. They may not be republished, resold or presented as another organisation's material.
5. Changes, ending access, and deletion
A change to these terms is published, and takes effect fourteen days later. A significant change is notified and acknowledged at next sign-in.
We give fourteen days written notice before we end or withdraw access, before we discontinue the platform or a material part of it, and before any planned deletion of work held on it, other than deletion under the retention periods in our Privacy Policy. Access is suspended immediately only where child safety, unlawful activity or a security incident requires it.
A school, a teacher or a participant may stop using the platform at any time.
A user, or a school on a student's behalf, may ask us to delete an account by writing to the address in section 6. We delete it and confirm in writing when it is done. What is deleted and what is kept is set out in our Privacy Policy.
6. Consumer guarantees, liability, disputes and raising a concern
Nothing in these terms excludes, restricts or modifies the guarantees given by the Australian Consumer Law.
We exclude liability for indirect and consequential loss so far as the law allows.
A school or an adult using the product indemnifies us for loss we suffer because of their unlawful conduct or their breach of section 3.
The platform is not guaranteed to be available without interruption, and we promise no service level and no support response time.
Tell us in writing about a dispute and we will meet in good faith to settle it. That does not stop anyone taking a matter to a court, a tribunal or a regulator at any time.
These terms are governed by the law of the Australian Capital Territory and its courts have non-exclusive jurisdiction. Nothing here limits a right to bring a claim where the user lives.
These terms and our Privacy Policy are the whole agreement between us about the platform. If we do not enforce a right straight away, we keep it. If a clause cannot be enforced, it is severed and the rest stands.
Either of us may transfer these terms only on written notice to the other, and only to someone who takes them on unchanged.
Raise a concern of any kind at official@shardlearning.com. A concern about a child's safety is handled under our Child Safety and Online Safety Policy.
